In consideration for being permitted by Jungle Fun Center to be on the premises and/or participate in various activities, including activities often provided by Jungle Fun Center, a company owned by Bourgo King Incorporated (referred to as “Jungle Fun Center”), for the enjoyment of parents, children, and other participants (referred to as “Participants”) at the following address: 6503 Hixson Pike, Hixson, TN 37343-7502. I, the undersigned, agree to all the terms and conditions set forth in this agreement, and do hereby release, and forever discharge and agree to hold harmless Jungle Fun Center, as well as the owners, directors, members, shareholders, employees, staff, and volunteers thereof from any and all liability, claims, or demand for personal injury, sickness (including, but not limited to bacterial infection, viral infection [including COVID-19, and all novel viruses], parasitic infection or fungal infection), or death, as well as property damage and expenses, of any nature whatsoever, which may be incurred by the undersigned or the Participants that arises out of, or in connection with, the undersigned’s or Participant’s being at Jungle Fun Center or participation in Jungle Fun Center activities from whatever cause, including the active or passive negligence of Jungle Fun Center and its owners, directors, staff, or members, and volunteers or any other Participants in the Jungle Fun Center activities. I also acknowledge that the Participants and the undersigned are voluntarily participating in Jungle Fun Center activities and agree to assume any and all risks, foreseeable or unforeseeable that may arise by that participation. In consideration for being permitted to be on the premises and/or participate in Jungle Fun Center activities, I hereby agree, for myself, my child, and the Participants of the party below, my heirs, administrators, executors and assigns, that we shall indemnify and hold harmless Jungle Fun Center from any and all claims, demands, actions, or suits arising out of or in connection with our or our party’s participation in Jungle Fun Center activities. I grant Jungle Fun Center, its owners, employees, agents, and representatives the irrevocable and unrestricted right to capture, use, reproduce, and distribute any photographs, video recordings, or other images (moving or still) taken of myself and/or my child(ren) while on the premises of Jungle Fun Center or participating in any Jungle Fun Center activities. These images may be used for promotional, advertising, social media, and other business purposes without compensation or notification. I understand that these images may be used in print, digital, or other media formats. I waive any right to inspect or approve the finished media in which my or my child(ren)’s likeness appears. Furthermore, I release Jungle Fun Center and its affiliates from any claims, demands, or liabilities related to the use of such media. If I do not consent to this media release, I will notify Jungle Fun Center in writing prior to participation. I ACKNOWLEDGE THAT I HAVE CAREFULLY READ THIS LIABILITY RELEASE FORM AND FULLY UNDERSTAND ITS CONTENTS. I AM AWARE THAT I AM, OF MY OWN FREE WILL, SIGNING A FULL RELEASE OF ALL LIABILITY. The undersigned is the responsible party for all participants attending at Jungle Fun Center during the timeline allotted and rented by the undersigned, including any time on the Jungle Fun Center premises. The undersigned further consents to the administration of first-aid and/or doctor’s care, or any other form of medical treatment necessitated by illness or injury to the Participant that may require the same. In the event of the necessity of such care or treatment of a Participant as heretofore described, the undersigned agrees to hold harmless and indemnify Jungle Fun Center, its owners, directors, employees and agents from any acts of malfeasance, and/or failure to act on the part of those chosen to administer medical care on behalf of the Participant. Additional signees beyond the primary signee agree to all of the above, with responsibility for themselves and any related or unrelated attendants.
